POSCO, meaning Protection of children from sexual offenses act 2012. It was set up to protect the children from crimes such as sexual harassment, child pornography, as well as sexual abuse. The objective of the act was to offer a child-friendly environment for trial where the perpetrators will be punished. The POSCO act is where a child below the age of eighteen is included under the law. It has made provision to avoid the re-victimization of the child.
New Amendment of POSCO Law:
Recently, the government has come up with the new POSCO amendment law. The criminal law amendment bill 2018, enhances the minimum criteria for the offense of rape against a girl child of all three classes of age. Now, under the new amendment, if the victim is below the age of 12 years, then the perpetrator will have a jail punishment for up to 20 years, which was ten years in previous years.
The death penalty is the severest punishment that will be given under the POSCO law. If there will be a gang rape of a child below the age of 12 years, then there will be life imprisonment.
If the victim is between the age of 16 and 18, then there is a punishable offense of 10-year jail and lifetime imprisonment in maximum cases. If there will be any repeaters, then there will be a punishment of death or life imprisonment. The cases will be resolved in a fast track court. The cases should be disposed of within six months
